The more I think about Harriet Miers, the more I begin to like her. Yesterday morning, I felt devastated. By last night, much of the initial shock had worn off. Now, I have a good feeling.
Here's a great post on the subject. It is a must read.
I think a lot of Miers' conservative credentials will be revealed in the months to come. She may well end up our most conservative jurist, in the mold of Clarence Thomas.
Consider this:
The same liberties that ensure a free society make the innocent vulnerable to those who prevent rights and privileges and commit senseless and cruel acts. Those precious liberties include free speech, freedom to assemble, freedom of liberties, access to public places, the right to bear arms and freedom from constant surveillance. We are not willing to sacrifice these rights because of the acts of maniacs.
That's Harriet Miers responding to a notorius shooting-spree in Texas. These aren't code words. This is a clear argument for an interpretation of the Second Amendment that guarantees an individual right to bear arms. More importantly, it's an endorsement of the strict-scrutiny approach to interpreting gun-control in light of the Second Amendment. Miers could very well be the best friend to gun owners in the history of the Supreme Court.
Only time will tell. As the magic 8 ball says "reply hazy, ask again later."
But we must have a little faith in the President. Miers won't be another Souter. When Bush 41 nominated Souter, he did so on the advice of John Sununu; he didn't know Souter personally. That was his mistake. Bush 43 learned a lot by watching the successes and mistakes of his father. When Bush 43 nominates an "unknown" like Miers, we must recognize that, while she is unknown to us, she is very, very well-known to him. She has been his personal lawyer and a member of his staff for almost two decades. We might be surprised, but he won't.
Considering that Bush has fought so hard for so many great judges, do we really think he is going to annoint someone he knows so well if she is going to be another Souter?
As the magic 8 ball says, "signs point to no."
UPDATE:
Read this! Why is Harriet Miers smiling?
Because Harry Reid is hosed, and he doesn't even know it.
Interesting that Federalist Society members support her...yet she wasn't one, choosing to spend years upon years in the ABA.
I also find you highly hopeful to seize upon her support for the 2nd, ignoring the implications of the other rights she supports in that 'graf. Freedom from surveillance? What does that portend for PATRIOT USA? Who knows, but liberals can reassure themselves too.

"Harry is hosed".
A beverage spurted from my nostrils when I read that.
Thanks a lot.
At least it helped my cold a bit.
Hilarious!
